Why am I NOT Eligible For an Expungement?
Some offenses, when committed in New Jersey, are not eligible for future expungement. Additionally, too many convictions on a criminal record may deem an individual ineleligible for expungement.
Pursuant to N.J.S.A. 2C:52-2, the following crimes are “non-expungeable”:
- Robbery
- Criminal Restraint
- Criminal Homicide (excluding Death by Auto)
- Kidnapping
- Luring or Enticing
- Aggravated Sexual Assault
- Aggravated Criminal Sexual Contact
- Criminal Sexual Contact (if the victim is a minor)
- Endangering the Welfare of a Child (if sexual contact involved)
- Perjury
- False Swearing
Additionally, if you one is convicted of distribution of CDS or possession with intent to distribute, he or she will not be eligible for an expungement in New Jersey UNLESS the conviction was for sale or distribution of 25 grams or less of marijuana or 5 grams or less of hashish.
