An Edison simple assault complaint is filed under N.J.S.A. 2C:12-1(a). In the ordinary case it is a disorderly persons offense (New Jersey’s rough counterpart to what other states label a misdemeanor) with a ceiling of 6 months in jail and a $1,000 fine. If both people agreed to fight, the grade falls to petty disorderly persons, where the limits are 30 days and $500. Neither grade is a crime in New Jersey, so there is no indictment and no jury: a judge decides the case at Edison Municipal Court, 100 Municipal Boulevard, Edison, NJ 08817.

We are William Proetta Criminal Law, and our Edison office at 3840 Park Ave, Suite 202A is a few minutes from the municipal complex. Most of the Edison simple assault cases we take on did not begin between strangers. In our experience they start at home: between spouses or partners, parents and grown children, siblings, or people splitting the rent on an apartment. Over more than 15 years of criminal trial work I have also learned that the first police report is not always the whole story.

Where Edison Assault Complaints Come From

Edison is a township of more than 100,000 people spread over sections with very different rhythms: Clara Barton, Menlo Park, North Edison, closer to the Metuchen and Metropark stations, South Edison around the NJ Transit station, and the Raritan Center business park, home of the convention and exposition center. A simple assault charge can begin in any of them.

Who writes the complaint. The Edison Police Department works out of the same complex at 100 Municipal Boulevard that houses the court, so the officers who sign many complaints and the courtroom where they are heard share an address. A call to 911 brings a patrol unit; the officers separate the people involved, take statements, check for injuries and look for camera footage, then sign the complaint themselves if they find probable cause.

Outside the home. The remaining cases grow out of ordinary friction: neighbors, a parking-lot confrontation, a shove during a commute. A complaint against someone under 18 goes to the Family Part in New Brunswick, not to Municipal Boulevard.

When nobody calls the police. A person who says they were hit can walk into the Edison court and ask to file a citizen complaint. It does not issue automatically. A judge or authorized court officer has to find probable cause first, and the complaint must be filed within one year of the incident.

Language. The New Jersey Judiciary provides court interpreters; tell the court early, using the number on your notice, if you need one. A statement given to police in a second language without an interpreter is something we look at closely.

When It Is Domestic Violence

Because so many Edison complaints involve people who share or once shared a home, this is often the part that matters most. Under N.J.S.A. 2C:25-19, the domestic violence law covers a spouse or former spouse, a co-parent, someone you dated, and anyone who is a present household member or was one at any time, so a current or former roommate qualifies. That label changes the case in four ways. A temporary restraining order can be entered the same night through Edison police, with the final hearing in the Family Part at 120 New Street in New Brunswick; conditional dismissal is barred; the order can direct police to seize your firearms, and a conviction makes later gun possession a state crime and can trigger a federal ban; and the person who called cannot simply drop the complaint, because the municipal prosecutor decides. Our page on domestic violence simple assault covers that track.

Immigration Concerns

Edison clients who are not U.S. citizens often raise immigration before they ask about jail, and with reason when the case is domestic. Under federal law, a conviction for a crime of domestic violence can make a noncitizen deportable, and whether a New Jersey simple assault fits that federal category may depend on the subsection, the mental state admitted and how the record describes the relationship. A court finding that someone violated the protective terms of a restraining order can be a separate removal ground, even with no criminal conviction at all. So the exact plea, and the factual basis spoken on the record, can matter as much as the sentence. In Padilla v. Kentucky, 559 U.S. 356 (2010), the Supreme Court held that defense counsel must advise a client about deportation risk before a plea. We go further and ask that the client’s immigration lawyer review any Edison plea first. Our page on domestic violence immigration consequences explains the federal rules.

How a Simple Assault Case Moves Through Edison Municipal Court

  1. Paperwork. Many people leave with a complaint-summons and a court date. A complaint-warrant means a first appearance from the county jail, usually by video, before release conditions are set.
  2. First listing. The judge advises you of the charge and the maximum penalty, and we enter a not guilty plea. Initial appearances are generally virtual.
  3. Discovery. We send a written demand to the Edison municipal prosecutor for the police report, body-worn camera video, the 911 recording, photographs and witness statements.
  4. Negotiation. The municipal prosecutor, not the person who complained, controls the charge.
  5. Trial or resolution. If there is no fair offer, the judge hears the witnesses and decides.

Mutual Fights and Cross-Complaints

Some Edison cases have two defendants. One person files, the other answers with a complaint of their own, and the court lists both together. That creates leverage on each side, but your own words can be used against you. When the municipal prosecutor cannot fairly prosecute both sides, the court may permit a private attorney to present one complaint after a conflict review.

Where the evidence suggests both people chose to fight, the State has to disprove mutual consent, and the realistic target becomes the petty disorderly grade; our page on the mutual fight rule explains the doctrine.

The Law in Brief, Conditional Dismissal and Expungement

“Bodily injury” includes pain alone, and our Middlesex County simple assault page explains each subsection, the aggravated assault line and sentencing.

A first-time defendant with no prior conviction and no earlier diversion may qualify for conditional dismissal: a year of monitoring, then dismissal. The court considers whether the offense was violent, and domestic cases and those involving a minor, elderly or disabled complainant are excluded. A dismissal can be expunged; a disorderly persons conviction generally needs 5 years.

How We Defend Edison Assault Charges

  • Self-defense. Once raised, the State must disprove it beyond a reasonable doubt.
  • Consent to fight. Proof of a mutual fight caps exposure at the petty grade.
  • No injury. No complaint of pain, no photos and no treatment weaken an (a)(1) charge.
  • The wrong person. A crowded parking lot or platform can produce a mistaken identification.
  • Motive and video. Doorbell and dashboard cameras, and messages sent before the incident, can decide credibility.
  • A civil reservation. If a plea makes sense, we ask the judge at the plea to bar its use in a lawsuit.
